Job Title: Senior Associate General Counsel - Compliance/Healthcare

Reports To: Chief Legal Officer

Department: Legal Department

Purpose: The Senior Associate General Counsel - Compliance/Healthcare ("Senior Associate General Counsel") provides advice, counsel, education, and strategic legal direction in the areas of healthcare compliance and other areas as needed in the Nuvance Health system.

Span of Control: A Senior Associate General Counsel may supervise an attorney, a paralegal, or an administrative staff member as determined by the Chief Legal Officer.

Position Summary: Reporting to the Chief Legal Officer, the senior Associate General Counsel is responsible for representing the company and providing legal advice and counsel to internal clients regarding all aspects of health care compliance. The Senior Associate General Counsel may also have responsibilities related to other certain healthcare matters including contract negotiations, policies, and transactions. The position will perform legal analysis and provide timely, effective, and practical legal guidance in a fast-paced in-house setting under the direction of the Chief Legal Officer.

Critical Responsibilities

  • Provide legal strategy and direction for compliance and other healthcare issues for Nuvance Health, including day-to-day advice and counsel to the Chief Compliance Officer and other Compliance Department personnel, C-suite clients, and management.
  • Provide advice on health care compliance and regulatory matters, and have expertise in laws related to billing and reimbursement, privacy (HIPAA and other privacy regulations), cybersecurity, federal and state fraud, waste, and abuse.
  • Maintain current knowledge of federal and state health care laws, with a particular emphasis on Fraud and Abuse, Stark, Anti-Kickback and Civil Monetary Penalty compliance, Medicare and Medicaid Conditions of Participation. Provide guidance and counsel to system executives to mitigate risk in these areas.
  • Oversee or lead complex compliance matters and investigations including self-disclosures.
  • Assist with the oversight and compliance with any regulatory reporting, including a corporate integrity agreement.
  • Collaborate on transactional matters, particularly physician acquisitions.
  • Advise and educate clients about compliance matters and the impact of recent regulatory and legislative changes and guidance.
  • Participate in committees and oversee the development of Nuvance Health policies and procedures that raise compliance, tax exemption, and health law issues.
  • Support the Corporate Compliance and Risk Management programs and provide legal advice related to compliance risk management issues.
  • Lead multi-disciplinary teams on matters of significance with system-wide impact.
  • Make presentations both inside and outside Nuvance Health and conduct teaching sessions for medical and professional staff and other employees regarding relevant legal issues. Work directly with outside counsel on issues requiring specialized legal consultation and serve as a liaison with outside counsel on referred legal matters.
  • Engage, oversee and evaluate outside counsel on issues requiring specialized legal consultation, negotiate and control legal fees and serve as a liaison with outside counsel on referred legal matters.
  • Supervise paralegal and administrative staff assigned.
  • Perform other duties as assigned consistent with a lawyer with more than ten years of experience in healthcare or related law.
  • Fulfills all compliance responsibilities related to the position.

          Education And Experience Requirements
          • Demonstrated and specialized subject matter expertise in healthcare compliance and regulatory law.
          • Minimum twelve (10) years of experience in healthcare compliance law or other applicable legal disciplines
          • Juris Doctorate
            License, Registration, or Certification Requirements: Admission to either Connecticut or New York Bar (both preferred), or a willingness to become admitted.
